This license agreement controls your right to use any image(s) downloaded from The Beeline (www.bton.com) or HiveCD for general purposes. You (hereafter referred to as "User") agree to be bound by the terms and conditions hereof by downloading any image(s), scripts, or software (hereafter referred to as "Media").

In consideration of the payment of the fees stated for downloading Media from Beeline Publications (hereafter referred to as "Owner"), and in further consideration of your acceptance of the provisions of this agreement, Owner hereby grants User a personal, nontransferable, nonexclusive right to use such images subject to the following terms and conditions:

Use

User may use Media on just one computer at a time for the following limited purposes:

for personal and, if a legal entity other than an individual, for internal company use, including comps (i.e., draft layouts for client review only). Under no circumstances shall your use extend beyond your personal or internal company use; and

Media may not be copied, distributed or used other than as set forth above. Under no circumstances shall Media be used for pornographic, libelous, defamatory, or any other improper or illegal purposes.

Extended Use

You understand and agree that, upon the payment of the appropriate fees, additional rights to use Media are available. For such extended use, check The Beeline at www.bton.com. User is licensed to use Media worldwide, with no limit on the number of times used, for:

advertising, promotional materials, posters, postcards, and product packaging;
online use including publicly published Web pages;
any and all products, publications (print or electronic), including products for sale; and,
personal, noncommercial, and fund-raising activities.

Ownership

All rights to Media are owned by Beeline Publications, Owner, and its licensers and are protected by United States copyright laws, international intellectual property treaties and other applicable laws. Owner and its licensers retain any and all rights, titles and interests not expressly granted by this license agreement. User may not transfer, assign or sublicense Media without the prior written consent of Owner. Any attempt to transfer or assign this license without prior written consent to do so shall automatically terminate this license.

Restricted Rights

Use, duplication or disclosure of Media by the United States of America is subject to "Restricted Rights," as that term is defined in the Department of Defense Supplement to the Federal Acquisition Regulations, and to paragraph 52.227-19(c)(2) of the Federal Acquisition

User Warranties

You, User, warrant that you will take all necessary steps to prohibit and prevent duplication or further distribution of Media.

Owner Warranties

Beeline Publications, Owner, warrants that the downloaded Media are free from defects in material and workmanship for thirty (30) days from the time of downloading and delivery. User's sole and exclusive remedy for a breach of this warranty is the replacement or the image(s) or refund of the purchase price at the sole option of Owner. Owner makes no other warranties, expressed or implied, and specifically disclaims any other warranties, including without limitation, any implied warranties of merchantability or fitness for a particular purpose. Some states do not permit the exclusion of implied warranties and you may have other rights which vary from state to state.

Damages

Beeline Publications shall not be liable for any general, special, direct, indirect, incidental or consequential damages arising out of the license and use of Media.

Termination

This agreement shall terminate upon violation of any of its provisions. Upon termination User must immediately stop using Media, delete all copies of such media from User's computer and all magnetic media storage devices.

Governing Laws

This agreement shall be controlled by the laws of the State of Indiana and venue for any disputes arising hereunder shall be brought in the courts in Bloomington, Indiana, USA.

Acceptance
